Wir verweisen auf die AGB \u0301s der DeHoGa Bayern und erg\u00e4nzen:<\/strong><\/p>\n \u00a0<\/p>\n Allgemeine Gesch\u00e4ftsbedingungen<\/p>\n f\u00fcr den Hotelaufnahme- und Bewirtungsvertrag<\/p>\n \u00a0<\/p>\n des Aston\u00b4s Hotel, Friedrichsplatz 4 in 90552 R\u00f6thenbach an der Pegnitz, dieses vertreten durch die Aston\u00b4s Gastro GmbH, Steinb\u00fchler Str. 11 in 90443 N\u00fcrnberg, diese vertreten durch die Gesch\u00e4ftsf\u00fchrerin Anita Freimane.<\/p>\n \u00a0<\/p>\n Weiterhin siehe auch Buchungsbestimmungen und Hausordnung des Aston\u00b4s Hotel.<\/p>\n \u00a0<\/p>\n Geltungsbereich<\/strong><\/p>\n Diese Gesch\u00e4ftsbedingungen gelten f\u00fcr Vertr\u00e4ge \u00fcber die mietweise \u00dcberlassung von Hotelzimmern zur Beherbergung, sowie alle f\u00fcr den Kunden erbrachten weiteren Leistungen und Lieferungen des Hotels. Die Unter- oder Weitervermietung der \u00fcberlassenen Zimmer sowie deren Nutzung zu anderen als Beherbergungszwecken bed\u00fcrfen der vorherigen schriftlichen Zustimmung des Hotels, wobei \u00a7 540 Abs. 1 Satz 2 BGB abbedungen wird, soweit der Kunde nicht Verbraucher ist. Gesch\u00e4ftsbedingungen des Kunden finden nur Anwendung, wenn dies vorher ausdr\u00fccklich schriftlich vereinbart wurde.<\/p>\n \u00a0<\/p>\n Vertragsabschluss, -partner; Verj\u00e4hrung<\/strong><\/p>\n Der Vertrag kommt durch die Annahme des Antrags des Kunden durch das Hotel zustande. Dem Hotel steht es frei, die Zimmerbuchung schriftlich zu best\u00e4tigen. Vertragspartner sind das Hotel und der Kunde. Hat ein Dritter f\u00fcr den Kunden bestellt, haftet er dem Hotel gegen\u00fcber zusammen mit dem Kunden als Gesamtschuldner f\u00fcr alle Verpflichtungen aus dem Hotelaufnahmevertrag, sofern dem Hotel eine entsprechende Erkl\u00e4rung des Dritten vorliegt. Alle Anspr\u00fcche gegen das Hotel verj\u00e4hren grunds\u00e4tzlich in einem Jahr ab dem Beginn der Kenntnisabh\u00e4ngigen regelm\u00e4\u00dfigen Verj\u00e4hrungsfrist des \u00a7 199 Abs. 1 BGB. Schadensersatzanspr\u00fcche verj\u00e4hren kenntnisunabh\u00e4ngig in f\u00fcnf Jahren. Die Verj\u00e4hrungsverk\u00fcrzungen gelten nicht bei Anspr\u00fcchen, die auf einer vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Pflichtverletzung des Hotels beruhen.<\/p>\n \u00a0<\/p>\n Leistungen, Preise, Zahlung, Aufrechnung<\/strong><\/p>\n Das Hotel ist verpflichtet, die vom Kunden gebuchten Zimmer bereitzuhalten und die vereinbarten Leistungen zu erbringen. Der Kunde ist verpflichtet, die f\u00fcr die Zimmer\u00fcberlassung und die von ihm in Anspruch genommenen weiteren Leistungen geltenden bzw. vereinbarten Preise des Hotels zu zahlen. Dies gilt auch f\u00fcr vom Kunden veranlasste Leistungen und Auslagen des Hotels an Dritte. Die vereinbarten Preise schlie\u00dfen die jeweilige gesetzliche Mehrwertsteuer ein. \u00dcberschreitet der Zeitraum zwischen Vertragsabschluss und Vertragserf\u00fcllung vier Monate und erh\u00f6ht sich der vom Hotel allgemein f\u00fcr derartige Leistungen berechnete Preis, so kann dieses den vertraglich vereinbarten Preis angemessen, h\u00f6chstens jedoch um 15% anheben.<\/p>\n \u00a0<\/p>\n Erg\u00e4nzung durch Buchungsbestimmung\/ Hausordnung<\/strong><\/p>\n Die Preise k\u00f6nnen vom Hotel ferner ge\u00e4ndert werden, wenn der Kunde nachtr\u00e4glich \u00c4nderungen der Anzahl der gebuchten Zimmer, der Leistung des Hotels oder der Aufenthaltsdauer der G\u00e4ste w\u00fcnscht und das Hotel dem zustimmt.<\/p>\n Rechnungen des Hotels sind am Anreisetag ohne Abzug zu zahlen. Das Hotel ist berechtigt, aufgelaufene Forderungen jederzeit f\u00e4llig zu stellen und unverz\u00fcgliche Zahlung zu verlangen.<\/p>\n Der Name s\u00e4mtlicher G\u00e4ste sind bei Hotelbuchungen dem Hotel mitzuteilen und Buchungen in Restaurant, Garten, Bar auf Verlangen dem Hotel vorab mitzuteilen. Sollten die G\u00e4ste Buchungen in Restaurant, Garten, Hotel nicht selbst in Anspruch nehmen oder weitere G\u00e4ste auf dem Gel\u00e4nde des Hotels empfangen wollen, beh\u00e4lt sich das Hotel vor, die Weitergabe der Buchung an Dritte und Einladung Dritter auf das Gel\u00e4nde des Hotels auch nachtr\u00e4glich zu jedem Zeitpunkt des Aufenthaltes zu untersagen.<\/p>\n Bei Zahlungsverzug ist das Hotel berechtigt, die jeweils geltenden gesetzlichen Verzugszinsen in H\u00f6he von derzeit 8% bzw. bei Rechtsgesch\u00e4ften, an denen ein Verbraucher beteiligt ist, in H\u00f6he von 5% \u00fcber dem Basiszinssatz zu verlangen. Dem Hotel bleibt der Nachweis eines h\u00f6heren Schadens vorbehalten.<\/p>\n \u00a0<\/p>\n Das Hotel ist berechtigt, bei Vertragsschluss eine angemessene Vorauszahlung in Form einer Kreditkartengarantie oder Sicherheitsleistung zu verlangen. Die H\u00f6he der Vorauszahlung und die Zahlungstermine k\u00f6nnen im Vertrag schriftlich vereinbart werden. Bei Buchungen zu Hochsaison, Messeterminen, Zeitr\u00e4umen starker Nachfrage, f\u00fcr welche seitens des Hotels Vermittlungsgeb\u00fchren anfallen oder aus anderen Gr\u00fcnden k\u00f6nnen Vorauszahlungen von bis zu 100% zuz\u00fcglich Sicherungszulage f\u00fcr zus\u00e4tzliche Leistungen innerhalb und au\u00dferhalb des Hauses zur Garantie der Buchung verlangt werden.<\/p>\n Der Kunde kann nur mit einer unstreitigen oder rechtskr\u00e4ftigen Forderung gegen\u00fcber einer Forderung des Hotels aufrechnen oder mindern.<\/p>\n \u00a0<\/p>\n R\u00fccktritt des Kunden (Abbestellung\/ Stornierung) Nichtinanspruchnahme der Leistungen des Hotels<\/strong><\/p>\n Ein R\u00fccktritt des Kunden von dem mit dem Hotel geschlossenen Vertrag bedarf der schriftlichen Zustimmung des Hotels. Erfolgt diese nicht, so ist der vereinbarte Preis aus dem Vertrag auch dann zu zahlen, wenn der Kunde vertragliche Leistungen nicht in Anspruch nimmt. Dies gilt nicht bei Verletzung der Verpflichtung. des Hotels zur R\u00fccksichtnahme auf Rechte, Rechtsg\u00fcter und Interessen des Kunden, wenn diesem dadurch ein Festhalten am Vertrag nicht mehr zuzumuten ist oder ein sonstiges gesetzliches oder vertragliches R\u00fccktrittsrecht zusteht.<\/p>\n Buchungs\u00e4nderungen von Zimmertyp, Anschrift, Rechnungsanschrift, Anzahl Personen, Buchungszeitraum oder jeder anderen \u00c4nderung der Buchungsmodalit\u00e4ten k\u00f6nnen pro Vorgang mindestens Euro 15,00 oder nach tats\u00e4chlichem Aufwand und Stundensatz dem Buchenden in Rechnung gestellt werden. Wir behalten uns die Vorkasse zu vorgenannter \u00c4nderung oder Belastung hinterlegter Kreditkarten vor.<\/p>\n Sofern zwischen dem Hotel und dem Kunden ein Termin zum kostenfreien R\u00fccktritt vom Vertrag schriftlich vereinbart wurde, kann der Kunde bis dahin vom Vertrag zur\u00fccktreten, ohne Zahlungs- oder Schadensersatzanspr\u00fcche des Hotels auszul\u00f6sen. Das R\u00fccktrittsrecht des Kunden erlischt, wenn er nicht bis zum vereinbarten Termin sein Recht zum R\u00fccktritt schriftlich gegen\u00fcber dem Hotel aus\u00fcbt.<\/p>\n Bei vom Kunden nicht in Anspruch genommenen Zimmern hat das Hotel die Einnahmen aus anderweitiger Vermietung der Zimmer sowie die eingesparten Aufwendungen anzurechnen.<\/p>\n Dem Hotel steht es frei, die vertraglich vereinbarte Verg\u00fctung zu verlangen und den Abzug f\u00fcr ersparte Aufwendungen zu pauschalieren. Der Kunde ist in diesem Fall verpflichtet, mindestens 90% des vertraglich vereinbarten Preises f\u00fcr \u00dcbernachtung mit oder ohne Fr\u00fchst\u00fcck, zu zahlen.<\/p>\n Die R\u00fcckerstattung voraus geleisteter Zahlungen abz\u00fcglich der pauschalisierten Aufwendungen gem\u00e4\u00df Staffelung der AGBs an den Kunden ist nach Verstreichen des Buchungszeitraumes auf Antrag des Kunden unter Nachweis der Weitervermietung und unter Nennung eines kostenfreien Zahlweges an den Kunden m\u00f6glich. Bei R\u00fcckzahlungen werden die Bearbeitungsgeb\u00fchren sowie bei nicht kostenfreien Zahlwegen die Zahlungsgeb\u00fchren zus\u00e4tzlich f\u00e4llig.<\/p>\n Dem Kunden steht der Nachweis frei, dass der oben genannte Anspruch nicht oder nicht in der geforderten H\u00f6he entstanden ist.<\/p>\n \u00a0<\/p>\n R\u00fccktritt des Hotels<\/strong><\/p>\n Sofern ein kostenfreies R\u00fccktrittsrecht des Kunden innerhalb einer bestimmten Frist schriftlich vereinbart wurde, ist das Hotel in diesem Zeitraum seinerseits berechtigt, vom Vertrag zur\u00fcckzutreten, wenn Anfragen anderer Kunden nach den vertraglich gebuchten Zimmern vorliegen und der Kunde auf R\u00fcckfrage des Hotels auf sein Recht zum R\u00fccktritt nicht verzichtet.<\/p>\n Wird eine vereinbarte verlangte Vorauszahlung auch nach Verstreichen einer vom Hotel gesetzten angemessenen Nachfrist nicht geleistet, so ist das Hotel ebenfalls zum R\u00fccktritt vom Vertrag berechtigt.<\/p>\n Ferner ist das Hotel berechtigt, aus sachlich gerechtfertigtem Grund vom Vertrag au\u00dferordentlich zur\u00fcckzutreten, beispielsweise falls h\u00f6here Gewalt oder andere vom Hotel nicht zu vertretende Umst\u00e4nde die Erf\u00fcllung des Vertrages unm\u00f6glich machen; Zimmer unter irref\u00fchrender oder falscher Angabe wesentlicher Tatsachen, z.B. in der Person des Kunden oder des Zwecks, gebucht werden; das Hotel begr\u00fcndeten Anlass zu der Annahme hat, dass die Inanspruchnahme der Hotelleistung den reibungslosen Gesch\u00e4ftsbetrieb, die Sicherheit oder das Ansehen des Hotels in der \u00d6ffentlichkeit gef\u00e4hrden kann, ohne dass dies dem Herrschafts- bzw. Organisationsbereich des Hotels zuzurechnen ist. ein Versto\u00df gegen oben Klausel I Nr. 2 vorliegt. Bei berechtigtem R\u00fccktritt des Hotels entsteht kein Anspruch des Kunden auf Schadensersatz.<\/p>\n \u00a0<\/p>\n Zimmerbereitstellung, -\u00fcbergabe und -r\u00fcckgabe<\/strong><\/p>\n Der Kunde erwirbt keinen Anspruch auf die Bereitstellung bestimmter Zimmer. Gebuchte Zimmer stehen dem Kunden ab 15.00 Uhr des vereinbarten Anreisetages zur Verf\u00fcgung. Der Kunde hat keinen Anspruch auf fr\u00fchere Bereitstellung. Am vereinbarten Abreisetag sind die Zimmer dem Hotel sp\u00e4testens um 12.00 Uhr ger\u00e4umt zur Verf\u00fcgung zu stellen. Danach kann das Hotel aufgrund der versp\u00e4teten R\u00e4umung des Zimmers f\u00fcr dessen vertrags\u00fcberschreitende Nutzung bis 13.00 Uhr 50% des vollen Logispreises (Listenpreises) in Rechnung stellen, ab 14.00 Uhr 100%.<\/p>\n \u00a0<\/p>\n Hausordnung<\/strong><\/p>\n Wir w\u00fcnschen, dass alle G\u00e4ste, sich so verhalten, dass andere G\u00e4ste und unsere Nachbarn nicht gest\u00f6rt werden.<\/p>\n \u00a0<\/p>\n Im Detail:<\/strong><\/p>\n Die Hausordnung ist Bestandteil der allgemeinen Gesch\u00e4ftsbedingungen. Bei Verst\u00f6\u00dfen gegen die Hausordnung ist das Hotel berechtigt, den Beherbergungsvertrag fristlos zu k\u00fcndigen. F\u00fcr dadurch ggf. nicht in Anspruch genommene Leistungen werden Stornogeb\u00fchren entsprechend der o.g. Stornoregelungen Regelungen f\u00e4llig.<\/p>\n \u00a0<\/p>\n Nachtruhe:<\/strong><\/p>\n ab 22.00 Uhr ist in allen Zimmern Zimmerlautst\u00e4rke einzuhalten. Auch auf den G\u00e4ngen und im Treppenhaus bitte ruhig verhalten.<\/p>\n \u00a0<\/p>\n Rauchverbot:<\/strong><\/p>\n Bitte beachten Sie das generelle Rauchverbot in unserem Haus. Die Zimmer und Flure sind mit hochempfindlichen Rauchmeldern ausgestattet. F\u00fcr jedwede Manipulation derselben werden die entstandenen Unkosten, mindestens jedoch \u20ac 500,00 in Rechnung gestellt. Bei Versto\u00df gegen das Rauchverbot in den Zimmern wird in jedem Fall sofort eine Vertragsstrafe in H\u00f6he von \u20ac 250 Euro f\u00e4llig (bei Gruppen haben Begleitpersonen, ggf. in Vertretung des Veranstalters, in Vorleistung zu treten). Diebstahl und vors\u00e4tzliche Sachbesch\u00e4digung werden unverz\u00fcglich zur Anzeige gebracht. Bei Abreise von Gruppen wird eine Begehung der Zimmer durch das Hauspersonal durchgef\u00fchrt. Ersatz f\u00fcr eventuelle Besch\u00e4digungen und f\u00fcr verlorengegangene Schl\u00fcssel und Codekarten wird in Rechnung gestellt und ist bei Abreise zu bezahlen. Das Hotel beh\u00e4lt sich vor, von einzelnen G\u00e4sten, insbesondere von Gruppen eine Kaution in H\u00f6he von bis zu \u20ac 250,00 pro Person zuz\u00fcglich der Logissumme pro Tag und Gast zu fordern.<\/p>\n Diese ist auf Verlangen sofort zu bezahlen. Die Kaution wird bei Abreise zur\u00fcckerstattet, bzw. mit eventuellen Schadenersatzforderungen verrechnet. F\u00fcr Sch\u00e4den, die dem Gast entstehen, haftet das Hotel nur, wenn der Schadensverursacher grob fahrl\u00e4ssig gehandelt hat. F\u00fcr im Gep\u00e4ckraum aufbewahrtes Gep\u00e4ck, sowie f\u00fcr Kraftfahrzeuge und Fahrr\u00e4der, die auf dem Gel\u00e4nde abgestellt werden, \u00fcbernimmt das Hotel keine Haftung.<\/p>\n \u00a0<\/p>\n Schlussbestimmungen<\/strong><\/p>\n Die Unwirksamkeit einzelner Bestandteile der vorliegenden Gesch\u00e4ftsbedingungen und Hausordnung l\u00e4sst die Wirksamkeit der \u00fcbrigen Bestandteile unber\u00fchrt. Im \u00dcbrigen gelten die gesetzlichen Vorschriften.<\/p>\n \u00c4nderungen oder Erg\u00e4nzungen des Vertrags, der Antragsannahme oder dieser Gesch\u00e4ftsbedingungen f\u00fcr die Hotelaufnahme sollen schriftlich erfolgen. Einseitige \u00c4nderungen oder Erg\u00e4nzungen durch den Kunden sind unwirksam.<\/p>\n Erf\u00fcllungs- und Zahlungsort ist der Sitz des Hotels. Ausschlie\u00dflicher Gerichtsstand \u2013 auch f\u00fcr Scheck- und Wechselstreitigkeiten \u2013 ist im kaufm\u00e4nnischen Verkehr der Sitz des Hotels. Sofern ein Vertragspartner die Voraussetzung des \u00a7 38 Abs. 2 ZPO erf\u00fcllt und keinen allgemeinen Gerichtsstand im Inland hat, gilt als Gerichtsstand der Sitz des Hotels.<\/p>\n Es gilt ausnahmslos deutsches Recht. Die Anwendung des UN-Kaufrechts und des Kollisionsrechts ist ausgeschlossen.<\/p>\n Sollten einzelne Bestimmungen dieser Allgemeinen Gesch\u00e4ftsbedingungen f\u00fcr die Hotelaufnahme unwirksam oder
